Question:

Could you please explain the procedure to determine the Mahr for marriage.

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Mahr or Sadaaq is the dowry given by the husband to the wife at the time of Nikah. The Mahr should be given to the wife at the time of marriage, however the husband may ask the wife to delay it for a later stage as well. The general practice of the Sahaba radiallahu anhum would be to give mahr to the wife before consummation of the marriage. If some is unable to readily give the mahr then it is better give a small portion of it to the wife at the time of nikah, and request the remaining to be a debt for a later stage. Since Mahr is the right of the bride, her consent is essential in making the mahr into a debt.1

Fuqaha’ have spoken about four types of Mahr.

Minimum Mahr:

The minimum amount of Mahr according Hanafi school of thought is 10 dirhams or anything which is equivalent to 10 dirhams in value.2 There is no maximum level for the mahr.

Mahr Mithl:

Mahr Mithl is the nominal amount of mahr which the womenfolk received in that houshold. To establish this norm one can look at dowry received by the womenfolk from the father’s side, such that they are similar in their age, beauty, virginity etc. The idea is to establish a similarity in setting the nominal mahr. This will be closest if all the qualities of a marrying parties are kept similar.3

Mahr Fatimi:

Mahr Fatimi is that dowry which Rasulullah salallahu alayhi wasallam stipulated for his beloved daughter Sayyidah Fatima al-Zuhra radallahu anha. There is a difference of opinion on how much this amount was. While one opinion suggests that it was 400 mithqaal of silver4, there are other narrations which allude towards 480 mithqaal.5 The latter is the preferred opinion according to contemporary fuqaha’.6

Note: It is preferable to use Mahr Fatimi as one’s mahr for nikah.

Mahr of Wives of Rasulullah salallahu alayhi wasallam:

Another value of dowry which is highlighted by the Fuqaha’ is the dowry which Rasulullah salallahu alayhi wasallam gave to his wives. The value is calculated at 500 dirhams of silver.

1وذلك لأن العادة عندهم تعجيل بعض المهر قبل الدخول حتى ذهب بعض العلماء إلى أنه لا يدخل بها حتى يقدم شيئا لها تمسكا «بمنعه – صلى الله عليه وسلم – عليا أن يدخل بفاطمة – رضي الله عنها – حتى يعطيها شيئا فقال يا رسول الله ليس لي شيء فقال أعطها درعك فأعطاها درعه» رواه أبو داود والنسائي، ومعلوم أن الصداق كان أربعمائة درهم وهي فضة، لكن المختار الجواز قبله لما روت «عائشة – رضي الله تعالى عنها – قالت أمرني رسول الله – صلى الله عليه وسلم – أن أدخل امرأة على زوجها قبل أن يعطيها شيئا» رواه أبو داود فيحمل المنع المذكور على الندب؛ أي ندب تقديم شيء إدخالا للمسرة عليها تألفا لقلبها وإذا كان ذلك معهودا وجب حمل ما خالف ما رويناه عليه جمعا بين الأحاديث.(الدر المختار وحاشية ابن عابدين (رد المحتار) (3/ 101))

2 (المهر أقله عشرة دراهم، أو ما قيمته عشرة دراهم. ولا يجوز أن يكون إلا مالا) … والنبي – عليه الصلاة والسلام – فسره بالعشرة، فقال فيما رواه عنه جابر وعبد الله بن عمر: «لا مهر أقل من عشرة دراهم»(الاختيار لتعليل المختار (3/ 101))

“وأقل المهر عشرة دراهم“…” ولا مهر أقل من عشرة ” ولأنه حق الشرع وجوبا إظهارا لشرف المحل فيتقدر بماله خطر وهو العشرة استدلالا بنصاب السرقة.(الهداية في شرح بداية المبتدي (1/ 198))

3(و) الحرة (مهر مثلها) الشرعي (مهر مثلها) اللغوي: أي مهر امرأة تماثلها (من قوم أبيها) لا أمها … وتعتبر المماثلة في الأوصاف (وقت العقد سنا وجمالا ومالا وبلدا وعصرا وعقلا ودينا وبكارة وثيوبة وعفة وعلما وأدبا وكمال خلق) وعدم ولد. ويعتبر حال الزوج أيضا، ذكره الكمال (الدر المختار وحاشية ابن عابدين (رد المحتار) (3/ 137))

ومهر مثلها يعتبر بنساء عشيرة أبيها، فإن لم يوجد منهم مثل حالها فمن الأجانب، ويعتبر بامرأة هي مثلها في السن والحسن والبكارة والبلد والعصر والمال. فإن لم يوجد ذلك كله فالذي يوجد منه (الاختيار لتعليل المختار (3/ 108))

4ذكر السيد الجمال الدين المحدث في روضة الأحباب: إن صداق فاطمة – رضي الله عنها – كان أربعمائة مثقال فضة، وكذا ذكره صاحب المواهب ولفظه أن النبي – صلى الله عليه وسلم – قال لعلي إن الله عز وجل أمرني أن أزوجك فاطمة على أربعمائة مثقال فضة (مرقاة المفاتيح شرح مشكاة المصابيح (5/ 2100))

5وعن أنس قال: جاء أبو بكر ثم عمر يخطبان فاطمة إلى النبى– صلى الله عليه وسلم– فسكت ولم يرجع إليهما شيئا، فانطلقا إلى على يأمرانه بطلب ذلك. قال على: فنبهانى لأمر، فقمت أجر ردائى حتى أتيت النبى– صلى الله عليه وسلم-. فقلت: تزوجنى فاطمة؟ قال: «وعندك شىء» قلت: فرسى وبدنى «1» ، فقال: «أما فرسك فلا بد لك منها وأما بدنك فبعها» ، فبعتها بأربعمائة درهم وثمانين، فجئته بها، فوضعها فى حجره، فقبض منها قبضة (المواهب اللدنية بالمنح المحمدية (1/ 234))
