Inheritance and a particular item

Question:

My dad passed away a few months ago last summer and I was supposed to visit him but he passed away before I did. He used to have a watch that he doesnโ€™t wear so I asked him if I can take that watch when I visit him, and he didnโ€™t mind (we had an agreement that I will take the watch). Am I eligible to take the watch or does it fall under inheritance?

First and foremost, our deepest condolences on the demise of your father. May Allah grant him maghfira and Jannah. ฤ€mฤซn

As far as the watch is concerned, in view of the information provided in the question, it will be looked at from the sharโ€™ฤซ perspective of hibah (gift).

In order for an item that is gifted to be considered your personal property, besides the verbal agreement, there has to be an actual possession taking place severing any connections from the gifter (wahib).

In the situation described in the question; you did not take possession of the watch before your father passed away. There was only a verbal agreement. Hence, the gist was remained incomplete.

Such an item becomes part of inheritance. You could still pursue the item and receive it with the permission of all the other heirs. If they mutually agree to give the item to you, it could be reconciled with portion of your part of the inheritance.[1]
