Talaq in state of depression or when one is mentally ill

Question:

If someone gives 3 Ṭalāq in one sitting and he is in the state of depression and is mentally ill, is this divorced valid?

Answer:

Bismillahi Taʿālā

Assalāmu ʿalaykum waraḥmatullāhī wabrakātuh,

Ṭalāq given in the state of depression is valid. The three divorces will institute as Ṭalāq al Mughalladhah which is irrevocable.

However, when it comes to a mental illness, then it is vital to take assistance from a local Scholar/Muftī. The scholar in turn should approach the doctor who is professionally assigned to the patient to assess the degree of disorientation.

The Muftī may also choose psychiatrist(s) of his choice to get the full understanding of the state of the patient mind. The Muftī should give his ruling of validity/invalidity of these divorces based on the testimony from genuine trustworthy doctors that the patient was out of his mind at the time of Ṭalāq.

مطلب في طلاق المدهوش وقال في الخيرية: غلط من فسره هنا بالتحير، إذ لا يلزم من التحير وهو التردد في الأمر ذهاب العقل. وسئل نظما فيمن طلق زوجته ثلاثا في مجلس القاضي وهو مغتاظ مدهوش، أجاب نظما أيضا بأن الدهش من أقسام الجنون فلا يقع، وإذا كان يعتاده بأن عرف منه الدهش مرة يصدق بلا برهان. اهـ. قلت: وللحافظ ابن القيم الحنبلي رسالة في طلاق الغضبان قال فيها:

إنه على ثلاثة أقسام: أحدها أن يحصل له مبادئ الغضب بحيث لا يتغير عقله ويعلم ما يقول ويقصده، وهذا لا إشكال فيه.

والثاني أن يبلغ النهاية فلا يعلم ما يقول ولا يريده، فهذا لا ريب أنه لا ينفذ شيء من أقواله.

الثالث من توسط بين المرتبتين بحيث لم يصر كالمجنون فهذا محل النظر، والأدلة على عدم نفوذ أقواله. اهـ. ملخصا من شرح الغاية الحنبلية، لكن أشار في الغاية إلى مخالفته في الثالث حيث قال: ويقع الطلاق من غضب خلافا لابن القيم اهـ وهذا الموافق عندنا لما مر في المدهوش
