Kufr statements and persistent doubt and worry

Question:

I want to understand the topic of apostasy in-depth, but I struggle to express myself because I am just so confused by what I read in the section of “Bahishti Zewar,” which is how I learned what apostasy even is. Before this, I didnโ€™t know one could leave the fold of Islam unintentionally by making ignorant statements. I had assumed that one would need to intentionally make a clear, declarative statement to leave Islam, just as one intentionally and clearly declares their faith when entering Islam.

I then continued to explore the subject on a Hanafi fiqh Q&A site run by a very renowned scholar who has since passed away. May Allah SWT be pleased with him.

What I ended up learning from these two sources over the years became burdensome for me. May Allah SWT forgive me for saying this. But I began overanalyzing everything my family, friends, and I said, did, or watched, worrying that we were all kafirs, had invalid marriages, illegitimate children, and so on. It wasn’t within my power to police everyone, but at the same time, I felt guilty for not telling others what they were saying, doing, or watching (because I learned even watching something with kufr in it could take you out of the fold) was making them kafirs. And now this is impacting my marriage too, Sheikh.

I want to live like a normal person. Iโ€™m so mentally and emotionally exhausted from worrying about this all the time.

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salฤmu สฟalaykum wa-rahmatullฤhi wa-barakฤtuh.

First and foremost, it should be understood that some of the texts of fiqh (Islamic jurisprudence) and aqidah (creed) do mention in detail the specific words and statements that can lead someone to leave the fold of Islam. The scholars highlighted these points to teach the public the importance of guarding one’s speech. If people take Islam lightly and do not show respect for the religion, Sharia, or anything sacred, this careless attitude and mockery can surely cause someone to come out of the fold of Islam. Therefore, it is crucial to be careful and respectful in what we say and how we act towards all aspects of the faith.

Allah Taโ€™ala himself has admonished us about this grave matter in the Qurโ€™an:

“If you ask them [about this], they will say: ‘We were only talking idly and playing.’ Say: ‘Is it Allah and His revelations and His Messenger that you were mocking?’ Make no excuse; you have disbelieved after having believed…”

These verses clearly demonstrate the gravity of mocking religious beliefs and the consequences of such actions. Although it is important that we are cautious with what we say, we should not allow ourselves to become overwhelmed and fall into waswasa (unwarranted doubts) about our faith based on statements mentioned in the classical texts of fiqh. These texts only aimed to clarify the importance of being cautious in our speech and attitude toward what is sanctified and sacred in the religion. [1]

Furthermore, it should be understood that falling into kufr (disbelief) is not a trivial matter, and the principles outlined by senior and authoritative theologians and jurists show that it is not so easy to completely leave the fold of Islam and become a murtad (apostate). The rigorous criteria and considerations provided by these scholars ensure that one does not hastily deem another, or oneself, as having fallen into disbelief. [2]

Here is an important text from Allamah Ibn Abidin al-Shami (may Allah have mercy upon him) regarding this [3]:

“A person cannot be excommunicated of their faith unless they reject the very principles that led them to it in the first place. Additionally, apostasy will only be judged based on clear and explicit acts or statements of apostasy. If there is doubt about whether something constitutes apostasy, it should not be treated as such, as firm belief in Islam is not lost due to doubt. This is because Islam always prevails in the heart of the believer.

โ€œโ€ฆand it is incumbent upon the scholar, when such an issue is presented to him, to not hastily declare the people of Islam as disbelievers, just he acknowledges the validity of the Islam of someone who is coerced…”

Itย stated in Jami’ al-Fusulayn and Fatawa Sughra: โ€˜Disbelief is a grave matter, so I do not consider a believer a disbeliever as long as I find a narration that says he is notโ€ฆโ€

โ€ฆAnd in ‘al-Khulasa’ and others, If there are aspects in any given issue that necessitate declaring someone a disbeliever and one aspect that prevents it, the mufti should lean towards the aspect that prevents declaring disbelief in order to think well of the Muslimโ€ฆ

It is added in alBazzฤziyya that unless the person explicitly intends what necessitates disbelief, then [in the case when his kufr is explicit] making interpretations [or excuses] for him is of no benefit…โ€

“In al-Tฤtarakhฤniyya, it is stated that a person cannot be legally declared a disbeliever due to an ambiguous or interpretable statement. This principle exists because declaring someone as a disbeliever carries the severest of consequences, which necessitates that the individual must have committed the gravest offense without any doubt. As such, this severe judgment cannot be based on uncertainty or ambiguous interpretationsโ€ฆ”

Thus, it has been made clear that no fatwa of disbelief can be issued against a Muslim if his words can be interpreted in a good way or if there is a disagreement about his disbelief, even if it is a weak fiqhฤซ narration.

Therefore, most of the statements mentioned [in the fiqh books] regarding declaring someone a disbeliever do not warrant issuing a fatwa of kufr, and I (Allamah Ibn Nujaym) have committed myself not to issue a fatwa based on them.โ€™ This is the summarized statement from ‘al-Bahr’.”

After reading and understanding the above-mentioned text, it is evident that declaring someone a disbeliever and expelling them from the fold of Islam is not that simple or easy. For this to happen, the disbelief must be absolutely explicit, deliberate, and intentional, with the person fully believing in what they are saying. [4]

In conclusion, for the preservation of our faith and the protection of Islam, we should always be careful of the words we utter, and we should never be irreverent, joking, or careless when speaking about religion.

1.) We should also abundantly recite the kalima ู„ุง ุงู„ู‡ ุงู„ุง ุงู„ู„ู‡ daily and make a litany of this blessed phrase on a daily basis, which will renew our faith constantly, as the Prophet ๏ทบ mentioned in a hadith.

Abu Hurairah (may Allah be pleased with him), narrates that the Messenger of Allah ๏ทบ said: “Renew your faith.” It was asked, “O Messenger of Allah, how can we renew our faith?” He said, “Say ‘La ilaha illallah’ in abundance.” (Tirmidhi)

2.) Also, make a habit of reciting Sura Kafirun before you sleep.

Farwah bin Nawfal (may Allah be pleased with him) came to the Prophet ๏ทบ and said, “O Messenger of Allah, teach me something to say when I go to bed.” He said, “Recite: Qul Ya Ayyuhal Kafirun, for it is a complete disassociation from polytheism.” [I.e., it establishes the oneness of Allah in the heart and removes one from polytheism and disbelief.] (Narrated by Tirmidhi)

3.) Recite in abundance the duโ€™a taught by the Prophet ๏ทบ to Abu Bakr Siddฤซq,

Ma’qal bin Yasar (may Allah be pleased with him): He went with Abu Bakr al-Siddiq (may Allah be pleased with him) to the Prophet (peace and blessings be upon him). The Prophet said, “O Abu Bakr, shirk (associating partners with Allah) among you is more hidden than the crawling of ants.” Abu Bakr replied, “Isnโ€™t shirk ascribing a partner with Allah?” The Prophet said, “By the One in Whose hand is my soul, shirk is more hidden than the crawling of ants.
