Is Fermentation-Produced Chymosin Halal? FPC, Rennet & Vinegar

Question:

I’m looking for fatwa on the below: Fermentation-produced Chymosin (FPC)
Also, are all vinegars halal irrespective of sources from Hanafi stand point?

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ʿalaykum wa-rahmatullāhi wa-barakātuh.

  1. The enzyme chymosin plays a vital role in the production of cheese. Traditionally, this enzyme, along with others such as pepsin, has been derived from rennet, which is an extract taken from the stomach of slaughtered animals. The usage of rennet derived from animals slaughtered in a non-Shariah compliant manner has been a matter of scholarly debate, with Darul Iftaa Canada’s position being that of impermissibility.

    In the last few decades, another method for producing chymosin was developed called fermentation produced chymosin (FPC). FPC involves inserting the chymosin gene into a plasmid, and then introducing that plasmid to a naturally-occurring microbe (which is not animal-derived). This leads to the microbes beginning to produce chymosin. The microbes are eventually filtered, and the chymosin protein is isolated and added to milk to produce cheese. [1]

    Unlike rennet, the final product does not contain any animal tissue and is therefore ḥalāl.
  2. All ordinary commercial wine vinegars—white or red—are ḥalāl by istiḥālah, while gourmet or sweetened variants that include added wine or grape must are to be avoided.[2]

بدائع الصنائع، كتاب الأشربة، ج٥ ص١١٣-١١٤، سعيد (ومنها) إذا تخللت بنفسها يحل شرب الخل بلا خلاف لقوله:عليه السلام نعم الإدام الخل، وإنما يعرف التخلل بالتغير من المرارة إلى الحموضة بحيث لا يبقى فيها مرارة أصلا عند أبي حنيفة رحمه الله حتى لو بقي فيها بعض المرارة لا يحل وعند أبي يوسف ومحمد تصير خلا بظهور قليل الحموضة فيها لأن من أصل أبي حنيفة رحمه الله أن العصير من ماء العنب لا يصير خمرا إلا بعد تكامل معنى الخمرية فيه فكذا الخمر لا يصير خلا إلا بعد تكامل معنى الخلية فيه وعندهما يصير خمرا بظهور دليل الخمرية ويصير خلا بظهور دليل الخلية فيه هذا إذا تخللت بنفسها، فأما إذا خللها صاحبها بعلاج من خل أو ملح أو غيرهما، فالتخليل جائز والخل حلال عندنا.  

لاختيار، كتاب الأشربة، ج٢ ص٣٢٣، مكتبة العمرية قال: (وخل الخمر حلال سواء تخللت أو خللت) لقوله ﷺ: «نعم الأدم الخل» مطلقا، وقال ﷺ: «خير خلكم خل خمركم» ولأن التخليل يزيل الوصف المفسد ويثبت وصف الصلاحية لأن فيه مصلحة قمع الصفراء والتغدي ومصالح كثيرة، وإذا زال المفسد الموجب للحرمة حلت كما إذا تخللت بنفسها اهـ  

تبيين الحقائق، كتاب الأشربة، ج٦ ص٤٨، امداديه قال – رحمه الله – (وخل الخمر سواء خللت أو تخللت) أي حل خل الخمر ولا فرق في ذلك بين أن تكون تخللت هي أو خللت… ولنا قوله – عليه الصلاة والسلام – «نعم الإدام الخل» مطلقا فيتناول جميع صورها؛ ولأن بالتخليل إزالة الوصف المفسد وإثبات صفة الصلاح فيه من حيث تسكين الصفراء وكسر الشهوة والتغذي به والإصلاح مباح كالدباغ، وكذا الصالح لمصالح مباح والاقتراب لإعدام الفساد فأشبه الإراقة والتخليل أولى لما فيه من إحراز مال يصير حلالا في المآل فيختاره من ابتلي به اهـ  

فتاوى محموديه، شراب کو سرکہ بنا کر استعمال کرنا، ج٢٧ ص٢١٨، دار الاشاعت؛ ج١٨ ص١٧٩، فاروقية تاڑی یا شراب کو اگر سرکہ بنا لیا جائے اور حقیقۃ بدل جائے تو اس کو کھانا درست ہے
